1. About these terms
EyeOn websites, including Eye on Southport, are operated by EyeOn Media Limited. These terms apply when you access our websites, newsletters and other services that link to them.
By using a service, you agree to these terms. If you do not agree, please do not use it. Our privacy and cookies notice separately explains how we handle personal information.
2. Using the site
You may use the site for lawful, personal and non-commercial purposes. You must not:
- break the law, infringe another person’s rights or encourage unlawful conduct;
- attempt to bypass security, interfere with operation, introduce malicious code or gain unauthorised access;
- use automated tools to extract, copy or republish substantial parts of the service without written permission, except legitimate search-engine indexing;
- misrepresent your identity or connection with EyeOn; or
- use our content or systems to build or train a commercial product or model without written permission.
We may restrict access where reasonably necessary to protect users, our systems, our rights or the integrity of the service.
3. Our journalism and information
We aim to report local news accurately and fairly, but journalism develops and information can change. Publication dates show when an item was first made available; an article may later be corrected, clarified or updated.
News and general information are not legal, financial, medical or other professional advice. You should obtain appropriate advice before acting on information where the consequences may be significant.
If you believe an article contains a material error, email [email protected] with the article URL and a clear explanation. We will consider correction requests under our editorial responsibilities.
4. Our content and intellectual property
The site and its text, photographs, video, graphics, branding, code and layout are owned by EyeOn Media Limited or used under licence. Copyright, trade mark, database and other intellectual property laws protect them.
You may view and share links to our public pages, and print a reasonable number of copies for personal use. You may quote limited extracts where permitted by law, with fair acknowledgement and a link to the original article. Any other copying, republication, commercial use, framing or systematic extraction requires prior written permission.
Nothing in these terms removes rights you have under copyright exceptions or other applicable law.
5. News tips, photographs and other submissions
If you send us material, you confirm that you have the right to do so and that, to the best of your knowledge, it is not unlawful, deliberately misleading or an infringement of another person’s rights.
You keep ownership of your material. You give EyeOn Media Limited a non-exclusive, worldwide, royalty-free licence to review, edit, reproduce, publish, distribute and archive it for our journalism and promotion of that journalism. This licence is perpetual for material we publish because news archives need to remain coherent. We will consider reasonable requests about attribution and safety, but cannot promise publication or confidentiality unless agreed with a journalist.
Do not put yourself or anyone else at risk to obtain material. Tell us if a submission is sensitive, subject to restrictions, or includes children or vulnerable people.
6. Availability, adverts and external links
We may change, suspend or withdraw any part of the service. We do not promise uninterrupted or error-free access, and we are not obliged to keep every item permanently available.
The site contains advertising and links to services operated by others. A link does not necessarily mean we endorse that service. Third parties control their own content, availability, contracts and privacy practices, and their terms apply when you use them.
7. Our responsibility to you
Nothing in these terms excludes or limits liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation. Your statutory rights as a consumer are not affected.
If you use the site as a consumer, we are responsible for loss or damage that is a foreseeable result of our breach of these terms or failure to use reasonable care and skill. We are not responsible for loss that was not foreseeable, for business loss arising from consumer use, or for events outside our reasonable control.
If you use the site for business purposes, the service is provided without warranties or conditions except those that cannot lawfully be excluded. Subject to the previous paragraph, EyeOn Media Limited is not liable for loss of profit, revenue, business, opportunity, goodwill, anticipated savings, data, or any indirect or consequential loss.
8. General terms
Changes
We may revise these terms to reflect changes to the service, law or our business. The updated terms apply from the date shown above. If a change materially affects a service you actively use, we will take reasonable steps to draw it to your attention.
Transfer and enforcement
We may transfer our rights and obligations under these terms as part of a reorganisation, sale or transfer of the relevant service, provided this does not reduce your legal rights. You may not transfer your rights without our agreement. If we delay enforcing a term, we may still enforce it later. If one term is found invalid, the remaining terms continue.
Law and disputes
These terms are governed by the law of England and Wales. If you are a consumer resident elsewhere in the UK, you retain the protection of mandatory local law and may bring proceedings in the courts where you live. Otherwise, the courts of England and Wales have exclusive jurisdiction.
